Matthew Mueller and Mary Mueller v. Oxford Community School District and Acme Shooting Goods, LLC
We’re suing the Oxford Community School District and the gun dealer responsible for the sale of the gun used in a mass shooting at Oxford High School in Michigan.
Background
Brady Legal and co-counsel Sommers Schwartz, P.C. are representing Matthew and Mary Mueller against the Oxford Community School District and Acme Shooting Goods, LLC (“Acme”), on behalf of their 14-year-old son, who was shot in the face and injured by a classmate in the 2021 mass shooting at Oxford High School. This is the first suit in relation to the Oxford High School shooting that also brings claims against Acme, which sold the gun used in this shooting.
“We are bringing this suit so that the failures both in the sale of this gun and at our school, which allowed this to happen, can never happen again. No family or community needs to experience this pain and no child should have to live with it for the rest of their life.”
— Matthew and Mary Mueller
The Muellers are seeking change and accountability to help prevent future tragedies and spare families and communities the pain and trauma they have experienced. In light of the Supreme Court’s NYSRPA v. Bruen decision, litigation to hold the gun industry accountable and foster industry reforms to prevent gun violence is more important than ever.
Lawsuit
Matthew and Mary Mueller filed a lawsuit seeking damages and injunctive relief from the Oxford Community School District, employees of the school district, and Acme Shooting Goods, LLC.
Our complaint alleges negligence on the part of the school district and district employees for not addressing the serious concerns about the well-being of the shooter that led to the shooting and the injury of the Muellers’ son. The complaint also alleges negligence on the part of Acme, which sold the firearm, despite actual or constructive knowledge that the school shooter’s father was unlawfully purchasing the firearm for his minor son. Specifically, upon information and belief, Acme ignored one or more red flags that the sale was unlawful and could foreseeably result in a juvenile using the firearm to cause injury and damage.
The suit seeks damages to account for the plaintiff’s care and injury as well as injunctive relief to reform the reckless practices that contributed to the mass shooting.
